Description

The post-conviction litigation of shifts in science is a key part of the Network's advocacy, and there has been much discussion on using shifts in traditional forensic science disciplines to exonerate our clients. Even though such litigation of scientific issues has led to hundreds of exonerations, applying a similar approach to shifts in social science research creates even more possibilities. After an introduction to the general litigation of shifted science claims, this session will focus on how advancements in social science research provide additional possibilities for undoing wrongful convictions. Such use of social science allows post-conviction litigators to bring in science to cases that were previously based on problematic non-scientific evidence, such as false confessions and mistaken eyewitness identifications. As the revolution in forensic science continues, such litigation of shifts in social science research presents a critical new frontier for the innocence movement.
