The National Registry of Exonerations lists over 150 cases in which medicolegal death investigation contributed to the false conviction. This panel brings together a senior researcher, forensic pathologist, and legal experts and will focus on cases in which the original forensic pathologist/medical examiner or other expert made a non-evidence-based diagnosis without scientific foundation. Panelists will discuss confirmation biases and commonly encountered errors, such as over-interpreting toxicologic results, unfounded time of death opinion, going beyond one's expertise, and attributing accidental injuries or illness to abuse. Panelists will discuss strategies to pursue in litigating faulty medicolegal death investigation cases, from developing new evidence and identifying appropriate experts to identifying claims for relief.
