This session will focus on developing and litigating police misconduct claims in wrongful conviction cases. Overturning wrongful convictions always requires a large team effort, but developing and litigating pattern and practice claims are particularly community and team driven. Attendees will hear from lawyers who have developed successful pattern and practice claims as well as an exoneree who recognized that the detective who framed him did the same to dozens of others and harnessed the community to expose the pattern and practice of misconduct. Using case examples, we will discuss (1) how to identify and investigate potential patterns and practices of police misconduct; (2) how to plead the pattern and practice; (3) how to litigate pattern and practice claims; and (4) how to strategically leverage these pattern and practice cases to overturn as many wrongful convictions as possible.
