Despite the rise of cooperative mechanisms for freeing people (like CIUs or agreements made after forensic testing), aggressive litigation remains an essential tool for lawyers to use in seeking exoneration. Sometimes, however, figuring out what to file, when to file it, whether to file, and what to do after you get to court can paralyze litigators. This nuts-and-bolts presentation features a panel of former public defenders, appellate lawyers, and civil-rights attorneys who have litigated a range of post-conviction matters and is designed to provide guidance about how to get a case moving and win. Strategies include getting back "in court" even if formal barriers might stand in the way and even where the exact path to victory may be murky.
