This session examines the scientific flaws of docimasia as a forensic tool for determining life outside the womb, particularly in criminal cases involving women accused of infanticide or outcomes of unassisted births. Using the case of Belén in Argentina as a focal point, the session will address how unreliable scientific practices and judicial biases can unjustly criminalize women after obstetric emergencies or miscarriages. The case of Belén is not unique to Argentina or Latin America; similar cases reflect a broader pattern of criminalization targeting women in vulnerable situations. This topic is especially relevant for the Innocence Network community following the U.S. Supreme Court's decision to overturn Roe v. Wade, which heightens the risk of criminal charges against women for reproductive events. The session emphasizes the importance of rigorous scientific standards to ensure justice, prevent wrongful convictions, and uphold human rights.
