Description

Expert testimony can make or break a case, and effectively handling expert witnesses is a cornerstone of courtroom advocacy. This session provides a practical dive into the fundamentals of direct and cross-examination of expert witnesses, with a focus on leveraging Federal Evidence Rule 803(18). Experienced trial attorneys will discuss key principles for examining experts and explore how to properly lay the foundation for admitting expert materials, reports, and publications under the learned treatise exception to hearsay. Participants will then break into small groups to practice laying the foundation for a fictitious expert report, receiving real-time feedback from peers and panelists.
