Traditional innocence-based litigation is often time consuming and difficult to pursue due to procedural obstacles, challenges in forensic testing, court backlogs, and more. For incarcerated clients, these delays can be devastating. Fortunately, there are many other complementary legal mechanisms through which attorneys can pursue release from incarceration while maintaining litigation based on factual innocence. Panelists will discuss alternative avenues for release, including resentencing, clemency, administrative advocacy, and medical release, which often focus on a client's rehabilitation and remorse. Topics will include preparing clients for alternative mechanisms; identifying and cultivating relationships in alternative spaces; and successfully negotiating tensions between competing values. Attendees will hear from a practitioner with extensive experience in securing releases, a former parole board member, and an exoneree who was first released through an alternative pathway.
