Is Your DNA Testing Statute Working? Using Litigation and Legislation to Expand Access
Description

More than 30 years after the first post-conviction DNA testing statute was enacted in the United States, getting access to such testing can remain all too often an expensive, time-consuming, and even fruitless process. Panelists representing diverse regions across the country (Washington State, Michigan, New Hampshire, and Colorado) will present on their recent efforts to amend their own state statutes, how to partner effectively with other organizations (such as Conviction Integrity Units) to effect legislative change, the problems faced by applicants for DNA testing in their states, and challenges faced in enacting and applying broadened legislation. Following the panel presentation, participants will have the opportunity to ask questions, workshop challenges faced in obtaining DNA in their home states, and brainstorm litigation strategies or changes to DNA testing statutes going forward with the goal of expanding access to DNA testing nationwide.
